South Okanagan Tours - Terms of Service

Liability

South Okanagan Tours makes every effort to ensure timely service for all scheduled tour pickups. However, factors beyond our control such as weather conditions, traffic delays, accidents, road closures, or other unforeseen circumstances may cause delays. South Okanagan Tours will not be held liable for any delays or inconveniences caused by these external factors.

South Okanagan Tours, along with our partner wineries, restaurants, and other venues, reserves the right to refuse service to any guest whose behavior disrupts the tour experience for others. This includes, but is not limited to, inebriation, unruly conduct, or any other behavior deemed inappropriate by our staff or partners. Guests asked to leave the tour for such reasons will be responsible for arranging their own transportation, and no refund will be provided.

South Okanagan Tours is not responsible for delays or missed tours due to flight cancellations, airline issues, or any other travel-related problems that result in a guest being unable to attend a scheduled tour.

By making a reservation with South Okanagan Tours, you agree to hold harmless South Okanagan Tours, its agents, representatives, employees, and affiliates from any direct, indirect, incidental, special, or consequential damages or loss of any kind.

Payment

All bookings are considered confirmed upon the collection of a credit card number, which will be securely stored on file via our online booking system. We accept Visa, Mastercard, American Express, and Discover.

Cancellations made 7 days or more before the scheduled reservation date will receive a full refund. Cancellations made within 7 days of the reservation date are non-refundable, and the full amount of the reservation will be charged.

We accept payment by Credit Card or E-Transfer. Should you feel your Tour Guide has provided exceptional service, a gratuity of 15-25% is suggested. For all prepaid tours or jobs billed to a card on file, a 15% gratuity will automatically be added for the staff assigned to your service.

For private tours and groups of eight or more guests, an 18% gratuity will be added to the total cost of the tour. This is non-negotiable.

Tour prices are subject to change based on availability and other factors. Any changes in pricing will be communicated promptly.

Conditions of Transport

South Okanagan Tours reserves the right, and delegates to its drivers the right, to refuse transportation to any individual who is believed to be under the influence of alcohol or illegal substances, or whose behavior is considered a threat to the driver, vehicle, or other passengers.

Smoking is strictly prohibited in all South Okanagan Tours vehicles.

South Okanagan Tours endeavors to ensure that all transfers arrive at the agreed-upon time. However, we will not incur any liability in the event of a delay due to causes beyond our control. Vehicles are fully insured for passenger and third-party claims as required by local law. However, South Okanagan Tours cannot accept liability for accidents or injuries that occur during any portion of the transfer. Customers’ property is carried entirely at their own risk, and we cannot accept responsibility for loss or damage.

Circumstances beyond the control of South Okanagan Tours may impact the timely delivery of guests to their destinations. We will not be liable for any interruptions or delays caused by factors outside our control, including but not limited to:

• Missed flights due to transportation delays

• Accidents causing delays to the vehicle

• Severe weather conditions such as snow or flooding

• Accidents or incidents on the road

• Vandalism or terrorism

• Unforeseen traffic delays

• Issues caused by other customers

• Incorrect booking details provided by the customer

This list is not exhaustive, and other circumstances may apply.

Damage and Clean-Up Fees

Any damage or spills caused by guests in our vehicles will result in additional charges for repair or clean-up costs. These charges will be assessed and communicated to the responsible party as soon as possible.

Vehicle Substitution

South Okanagan Tours reserves the right to substitute a vehicle with another of the same or similar size, if necessary, without prior notice to the guest.
